29 Riverfront Homes Face Demolition as SC Dismisses Appeal

The Supreme Court has dismissed a civil appeal challenging the National Green Tribunal’s (NGT) July 1, 2024 order that mandated the demolition of 29 bungalows constructed within the blue flood line of the Indrayani river in the Chikhali area of Pimpri Chinchwad. These structures, part of the ‘River Villa’ project developed by VSquare, were deemed illegal, and the NGT had directed the recovery of ₹5 crore as environmental damage compensation (EDC) from the owners, calculated based on the area occupied by each bungalow. The SC, in its May 5 order, upheld the NGT directive, stating there was no reason to entertain the appeal, and clarified that if the PCMC seeks compensation from the developer, VSquare may pursue the appropriate legal route.

The Pimpri Chinchwad Municipal Corporation (PCMC) is now preparing a demolition plan, although no fresh deadline has been set by the Supreme Court. PCMC officials have confirmed that action will be initiated soon. Meanwhile, lawyers representing VSquare have indicated that they may seek legal remedy if the developer is held liable for the EDC. Property owners, many of whom claim to have purchased their homes through registered sale deeds and taken loans, have urged the municipal commissioner to conduct a resurvey of the flood line before demolitions begin, arguing that they built their homes in good faith and are now facing undue hardship.
