Housing Society Reforms Registration Fee to Double, Online GBMs Legalised

The Maharashtra government has proposed key amendments to the Maharashtra Cooperative Societies Rules, 2025, aiming to modernize and streamline housing society operations. The draft rules, published on April 15, suggest doubling the registration fee for housing societies from ₹2,500 to ₹5,000 and legally recognizing online general body meetings (GBMs) with provisions for virtual participation and voting. The reforms also seek to standardize maintenance charges by mandating uniform service fees per unit instead of basing them on carpet area and propose lowering the maximum interest on delayed maintenance dues from 21% to 12% per annum (simple interest). Stakeholders have been invited to submit feedback by May 15, and the final implementation is expected later this year.

In addition to digital reforms, the draft introduces several financial and administrative changes to strengthen cooperative housing governance. It includes mandatory provisions for creating multiple funds such as reserve, sinking, major repairs, and welfare funds. New rules simplify name reservation processes, ease the procedure for filling casual vacancies without involving election authorities, and address property transfer issues by accepting family settlement deeds and allowing provisional membership for nominees. To promote redevelopment, societies will now be allowed to borrow up to 10 times the value of their land, with a condition that developer selection be video-recorded in the presence of at least 51% of members. These comprehensive changes reflect a practical, inclusive approach to addressing longstanding challenges faced by housing societies.
