MahaRERA says both physical and virtual hearings available after HC directive on hybrid option

The Maharashtra Real Estate Regulatory Authority (MahaRERA) has clarified that it already offers both physical and virtual hearings for complaints, allowing parties to appear in person whenever they request. This statement comes after the Bombay High Court directed MahaRERA to resume hybrid hearings, emphasising that access to justice must include the option of physical presence. The directive followed a petition from a homebuyer seeking the restoration of hybrid hearings and quicker execution of orders pending since March 2024. While MahaRERA’s counsel informed the court that physical hearings are available on request, the judges expressed concern over the perception that virtual-only proceedings were being prioritised, especially since most courts have resumed hybrid formats. The court also asked the authority to review its April 2025 circular and procedures for urgent listings, enforcement of orders, case mentions, and pronouncement of reserved orders.
MahaRERA officials said in-person hearings are conducted regularly, noting that over the past six months, 81 complaints were heard physically in seven sessions by the chairperson, with other matters handled by the full bench. They highlighted reforms to improve efficiency, such as publishing pre-notified cause lists, recording attendance, and fast-tracking urgent matters like health-related cases or court-directed listings. The state government has also appointed revenue recovery officers in six high-pendency districts on MahaRERA’s recommendation. While many legal professionals prefer virtual hearings for convenience, some, especially those handling complex cases, favour physical appearances for better credibility assessment. Advocates and activists agree that a balanced hybrid model ensures fairness, reduces costs, and improves accessibility while maintaining the dignity of proceedings.
