Bombay High Court’s Big Move on Housing Redevelopment in Maharashtra.

The Bombay High Court has delivered a landmark judgment that will significantly impact the redevelopment of housing societies across Mumbai and Maharashtra. The court ruled that district deputy registrars (DDRs) of co-operative societies can no longer demand approval or No-Objection Certificates (NOCs) from societies before redevelopment. This decision follows the case of the Bandra Nisha Cooperative Housing Society, where redevelopment was stalled due to the DDR’s interference. The court clarified that the Maharashtra Co-operative Societies Act does not grant DDRs the power to seek NOCs or obstruct redevelopment. Their role is now limited to overseeing transparency and ensuring that every society member has an equal chance to participate in decision-making.As per the order, the general body of the housing society holds the ultimate authority over redevelopment matters. DDR officials can only act as observers to confirm proper quorum, voting, and documentation. The Commissioner of Cooperation has been directed to circulate the court’s order statewide to reinforce transparency. The Mumbai Grahak Panchayat (MGP) has welcomed the verdict, calling it a crucial move to curb corruption and bring fairness to the redevelopment process. This ruling is expected to ease the burden on housing societies and developers by removing unnecessary bureaucratic hurdles that have delayed numerous projects.
