Bombay High Court Orders PMC to Act Against Kausarbaug Encroachments in First Hearing Itself, No Replies Sought
Bombay High Court on September 10 directed Pune Municipal Corporation and other authorities to act against alleged encroachments along key roads in Kausarbaug area in Kondhwa after the Kausarbaug Residents Forum filed a petition alleging widespread unauthorised commercial activity and encroachments on public roads, footpaths, open spaces and playgrounds. In a rare move, the bench comprising the Chief Justice and Justice passed the order in the very first hearing without calling for replies from respondents including the state government, district collector, PMC, police commissioner and MSEDCL, observing that authorities are duty-bound to ensure roadsides are not encroached upon. The HC directed authorities to issue notices to owners of encroaching structures in accordance with law and conclude proceedings as per prescribed legal procedure. The petitioner's lawyer described it as rare for the court to pass an order at the first hearing itself, saying the court viewed it as a fundamental duty of authorities to act.
Kausarbaug is known for its food establishments and sees a surge in commercial activity during Ramzan when fruit and food stalls including temporary ones are set up across the area attracting visitors from across the district. Residents said they have consistently raised encroachment concerns during annual pre-Ramzan meetings with police and municipal officials over the past two years without meaningful resolution. The forum's petition sought removal of illegal structures, unauthorised eateries and temporary stalls, regulation of commercial activity on public roads and open spaces particularly during Ramzan, action against illegal parking and unauthorised rickshaw stands, permanent ambulance and fire service access, improved sanitation and enforcement of fire safety norms including a ban on open-fire cooking without valid NOC. Residents clarified they are not opposed to businesses but want a safe environment where eateries follow all norms and residents do not face congestion, safety risks or restricted access to their own neighbourhood.
