New Redevelopment Rules Replace 2019 Framework, But Ongoing Projects Left in Limbo Over How GR Will Apply

Housing societies undergoing redevelopment have broadly welcomed the state government's new framework issued through a September 30 government resolution GR under Section 79A of the Maharashtra Co-operative Societies Act, which replaces the July 4, 2019 framework and prescribes detailed procedures covering redevelopment decisions, appointment of architects and project management consultants, project reports, tendering, developer selection, agreements, transit accommodation and allotment of premises. The new framework aims to bring greater transparency, competitive bidding and stronger safeguards for society members, but managing committee members have raised serious concerns over the GR linking contraventions to action under Sections 79A(3) and 78A of the Act, which they say could make elected committee members reluctant to take complex technical, legal and commercial decisions for fear of being personally exposed to disputes over procedural lapses. Members also sought clarity on how the September 30 GR would apply to projects where certain stages have already been completed under the earlier 2019 rules, warning that ambiguity on this could put managing committee members at legal risk.

Members said while they fully support accountability and safeguards for general body members, the elaborate mandatory process could significantly delay redevelopment projects particularly those already in progress. They emphasised that the general body must retain the final say in decisions regarding redevelopment of its own property and that the new framework should not become just another clearance mechanism adding bureaucratic layers without protecting residents' real interests. A member of a 40-year-old housing society in the city said the transition provisions need to be clearly spelt out by the government to prevent managing committee members of ongoing projects from being unfairly caught between two different sets of rules. For Maharashtra's thousands of ageing housing societies that urgently need redevelopment, getting the new framework's implementation right will determine whether the GR accelerates or further delays the already complex and protracted process of rebuilding homes for existing residents.
